1. Parties
This Membership Agreement (the "Agreement") is concluded between ibansource (address: Çamtepe Mahallesi Camii Sokak No: 1 Daire: 12, 35330 Narlıdere, İZMİR, Türkiye; e-mail: info@ibansource.com; phone: +90 555 555 55 55; tax office/no: — / —; MERSIS: —) (the "Company") and the natural or legal person registering at https://test.ibansource.com (the "Member") when the Member accepts it electronically on the registration form.
2. Definitions
- Site: the website at https://test.ibansource.com and its sub-pages.
- Service: IBAN format/check-digit validation, identification of the bank or financial institution an IBAN belongs to, access to institution and branch information, and related web and API services.
- Plan: a free or paid plan defining the quota, features and term of the Service.
- API Key: a secret key issued to the Member for programmatic access in API plans and plans including API access.
- Account: the page where the Member manages profile, billing, subscription, payment, API and agreement information.
3. Subject
This Agreement sets out the terms under which the Member uses the Service as a registered member. Paid Plan purchases are additionally governed by the Pre-Contractual Information Form and the Distance Service Agreement. Information on personal data processing is set out in the Privacy Notice (KVKK).
4. Membership
- You must be at least 18 years old and have legal capacity. A person registering on behalf of a legal entity declares that they are authorised to do so.
- Membership is completed when the registration form is filled in correctly, this Agreement is accepted and the e-mail address is verified.
- The Member confirms that registration and billing details are accurate, up to date and their own, and will keep them updated on the Account page. The Member is responsible for invoices that cannot be issued, or are issued incorrectly, because of inaccurate details.
- Membership is personal and may not be transferred or shared.
5. Account and API Key Security
- The Member is responsible for keeping their password and API key confidential. The Company stores them in a form that cannot be read back; the full API key is shown only once, when it is created.
- A Member who suspects that their key has been compromised must rotate it immediately under Account › API and inform the Company. Requests made with the key until rotation count against the Member's quota.
- Actions taken from the Member's account are deemed to have been taken by the Member unless proven otherwise.
6. Scope and Nature of the Service
- The free Plan offers a limited number of daily IBAN lookups on the Site. Quotas, features, terms and prices of paid Plans are published on the Pricing page.
- IBAN validation is an algorithmic check: it shows whether an IBAN complies with the international standard (ISO 13616) and check-digit rules and which institution it belongs to. It does not confirm that the account is open, active or owned by a specific person, the identity of the holder, or that a payment is safe.
- Institution and branch information is compiled from public sources and updated regularly; changes made by institutions may be reflected with a delay.
- Decisions on payments and other financial transactions made in reliance on the Service are the Member's responsibility. For significant payments, we recommend confirming the recipient's details through your bank.
- The IBANs looked up are not stored by the Company.
7. Acceptable Use
The Member shall use the Service lawfully and in accordance with this Agreement. In particular, the following are prohibited:
- using the Service for fraud, money laundering, terrorist financing, phishing or any other unlawful purpose;
- opening multiple accounts to exceed quotas, scraping the Site with automated tools (other than the API), or attempting to circumvent limits or security measures;
- sharing or selling the API key, or reselling the Service as an intermediary without the Company's written consent;
- copying, reverse engineering, overloading or disrupting the Service's code, database or infrastructure;
- bulk extracting institution and branch data to build or publish a database.
8. Paid Services
Paid Plans are prepaid for the chosen term (monthly/yearly); they do not renew automatically. Renewal, upgrade, cancellation and refund terms are set out in the Distance Service Agreement and the Cancellation and Refund Policy. The Company may change Plan prices and contents for future purchases; changes do not affect terms already paid for.
9. Intellectual Property
All rights in the Site's design, software, texts, logo, compiled institution database and other content belong to the Company or its licensors. The Member is granted only the right to use the Service under this Agreement. Institution names and logos belong to the respective institutions and are shown for identification only.
10. Service Continuity
The Company takes reasonable technical and organisational measures to keep the Service running without interruption or error. Planned maintenance is announced in advance where possible. The Company is not liable for interruptions beyond its control, such as force majeure, infrastructure and third-party provider outages or cyber attacks. For paid Plans, the subscription may be extended by the duration of a prolonged outage caused by the Company upon the Member's request.
11. Limitation of Liability
Except for intent or gross negligence and liabilities that cannot be limited towards consumers by law, the Company is not liable for indirect damages, loss of profit or loss of data arising from transactions made in reliance on the Service. For Members who are merchants, the Company's total liability is limited to the amount paid by the Member to the Company in the 12 months preceding the event giving rise to the claim.
12. Suspension and Termination
- The Member may cancel their subscription on the Account page at any time or request termination of their membership by writing to info@ibansource.com. On termination, personal data is anonymised as described in the Privacy Notice (KVKK).
- The Company may temporarily suspend the account and API keys if the Member breaches this Agreement or the law, in case of suspected unlawful use or at the request of an authority; in case of serious or repeated breach it may terminate the Agreement by notice. Refunds for unused time on termination for just cause are assessed under the Cancellation and Refund Policy.
13. Changes
The Company may update this Agreement due to changes in law or the Service. The current version is published on the Site with its version number and effective date. For significant changes affecting the Member's rights, the Member is asked to accept the new version on the Account page; paid Plans cannot be purchased until it is accepted. A Member who does not accept may terminate their membership; terms already paid for continue under the existing conditions. Previously accepted versions are available under Account › Agreements.
14. Notices and Evidence
Notices are sent to the Member's registered e-mail address and to the Company's contact details above. The Member must keep their e-mail address up to date. In disputes, the Company's electronic records, agreement acceptance records and server logs constitute evidence under the Code of Civil Procedure No. 6100; the Member's right to submit any evidence is reserved.
15. Governing Law and Disputes
This Agreement is governed by Turkish law. Members who are consumers may apply to the Consumer Arbitration Committee at their place of residence or where the transaction was made within the monetary limits announced annually by the Ministry of Trade, and to Consumer Courts above those limits. For disputes with merchant Members, the courts and enforcement offices at the Company's registered seat have jurisdiction.
16. Entry into Force
This Agreement consists of 16 articles and enters into force when accepted electronically by the Member. The acceptance record (version, date, time and IP address) is kept by the Company and can be viewed on the Member's Account page.
